Sen jälkeen uusissa laitteissa pitää olla se paikallinen rajapinta josta datan saa ulos.
Se tuskin on velvoittavana että sen jälkeen ei saa asentaa muita laitteita? Eli luultavasti esim vesilaitos voi käyttää vanhoja mittareita varastosta ilman paikallista rajapintaa kunhan ne on ostettu ennen em.päibämäärää
Hiukan pelkään, että odotukset ovat tämän ketjun viesteissä turhan suuret. Esimerkiksi vesimittari ei kerää muuta tietoa kuin mittaturbiinin tai ultraäänidoppler-mittauksen keräämän virtaaman kumulatiiviset tiedot (toki jos voi olla maksimilukemia ja virhetilastoja tms.). Tyypillisissä mittareissahan lukema on jatkuvasti näkyvissä näytöllä ja muita tietoja vuorotellaan. Joka iikkahan voi asentaa IR-kameran tms. mittarin päälle lukemaan jatkuvasti näyttöä. Näin ollen laitteessa on jo luonnostaan eräänlainen rajapinta. Käsittääkseni tuo näyttö on myös riitatapauksissa yleensä ratkaiseva, jos etäluku antaa poikkeavat lukemat.

Joidenkin laitteiden keräämät laajat historiatiedot (vrt. autot) on toinen kysymys ja kaiketi direktiivin ensisijainen kohde (ts. tarkoitus on estää noiden muodostuminen rahastuksen kohteeksi tai muuttuminen muun kuin kuluttajan ansainnan lähteeksi, omaisuudeksi tai jopa lievänasteisen kiristyksen kohteeksi).

Säädöksen yhtenä tarkoituksena on vapauttaa esimerkiksi huoltotoimintaa, jolla pienet firmat pystyy saamaan laitteesta tiedot jotka vaatii muuten valmistajakohtaiset lisenssit / loggerit

Hmm... olen kyllä sitä mieltä datasäädös velvoittaa tuon reaalidatan saamiseen tavalla tai toisella per nyt. Sitä varten asiassa oli kahden vuoden siirtymäaika että asiaan pystyi valmistautumaan. Mulle on ihan sama miten asia toteutetaan mutta koska pitää olla tarjota dataa niin se että näen mittarista luvut - ei ole riittävä. Ei myöskään ole riittävää se että sähkömittarissa vilkkuu ledi johon voi kyllä rakentaa (niinkuin minulla on) vaikka ESP32 anturilla siihen logituksen joka menee HA:han. Mutta kun haluan että toimijat noudattavat säädöksiä.

Kotiautomaatioprojektien käyttäjät yhteisöissä eivät enää pääse ajoneuvoon käsiksi tavalliseen tapaan. Ajoneuvon tietoihin pääsee kuitenkin käsiksi uuden BMW- ja MINI CarData -käyttöliittymän kautta. Tietoa CarDatasta löytyy Connected Drive Portal / MINI Connected -portaalista.

Mitenköhän Mersuissa pääsee kiinni ajoakun lataustilanteeseen ? Developer tunnuksen kautta pääsee kunhan on y-tunnus ja maksaa kuukausimaksun halutusta datapaketista. Mutta ei tuo oikein toimi yksittäiselle kotiautomaation kehittäjälle. Onko jollain tarkempaa tietoa ?

Datasäädöksen perusteella ei pitäisi olla enää ongelmaa, vaan valmistajan tulee antaa pääsy kaikkeen heidän autosta keräämäänsä dataan rajapinnan kautta.
Itselle herännyt epäilys että tämä rajapinta on OBD portti, mutta siihen pitäisi saada jokin lukija mikä aktiivisesti raportoi tiedot omalle serverille

Erittäin mielenkiintoista luettavaa sähkömittarien toiminnasta ja mitä kaikkea dataa se lähettää.
AMR 2.0 mukaisten mittarien on lähetettävä vähintään 15min välein 5min tasetieto verkkoyhtiölle ja se sisältää kaiken mittarin keräämän raakadatan. Sen jälkeen verkkoyhtiö perkaa dataa ja filtteröi virheet pois, tai kerää puuttuvat datat uusiksi.

Mittalaitteen tulee mitata seuraavien suureiden hetkellisarvot: vaihekohtainen pätö- jaloisteho, jännite ja virta sekä sähköverkon paikallinen taajuus. Hetkellisarvot tulee ollasiirrettävissä ulkoisiin laitteisiin mittauslaitteen paikallisen tiedonsiirtorajapinnan kautta.Mikäli hetkellisarvoja käytetään asiakaslaskutuksen perusteena, esim. kuukauden huipputeho, tulee ne rekisteröidä mittalaitteen muistiin ja välittää asiakkaalle. Muiden kuin laskutuksessakäytettävien hetkellisarvojen rekisteröinnistä päättää verkonhaltija (esim. minimi- jamaksimiarvot tietyllä ajanjaksolla). Asiakas tai asiakkaan valtuuttama kolmas osapuoli voivathyödyntää mittalaitteen mittaamia hetkellisarvoja energiatehokkuustoimenpiteissä sekäsähkönkulutuksen ja tehonkäytön optimoinnissa.

Mittauslaitteen tulee rekisteröidä kaikki – myös alle kolmen minuutin pituiset –jännitteettömät ajat. Jännitteetöntä aikaa koskevat tiedot tulee välittää asiakkaalle.

Kaikki mittalaitteen rekisteröimät tiedot tulee voida lukea mittauslaitteiston muististaviestintäverkon kautta (etäluentaominaisuus).

Mittauslaitteessa tulee olla paikallinen fyysinen tiedonsiirtoväylä, joka perustuu yleisestikäytössä olevaan, laitetoimittajariippumattomaan avoimeen standardoituuntiedonsiirtorajapintaan. Tiedonsiirtoväylän tulee mahdollistaa reaaliaikaisen mittaustiedon,kuten hetkellisen teho- ja kulutustiedon välittäminen (push) väylään kytketyille laitteille.Rajapinnan kautta välitettävien tietojen päivitystiheys tulee olla vähintään kerran viidessä (5)sekunnissa

Nyt kun päästiin 15min mittausjaksoon, niin vaatimuksessa on vielä hieman kovempi taso
Mittausjakso tulee ollaohjelmallisesti muutettavissa etäyhteyden välityksellä yhdestä (1) tunnista viiteentoista (15)minuuttiin. Myös tätä lyhyempi viiden (5) minuutin ja kolmen (3) minuutin mittausjakso tuleeolla mahdollinen.

Vastaukselle annettu takarajaksi 12.10.2025 minkä jälkeen käännytään valvovan viranomaisen puoleen, eli Traficomin suuntaan.
Jos Traficom asettuu verkkoyhtiöiden kannalle, voi lähteä kyselemään tarkennusta EU suunnasta vielä - mutta silloin homma kestää, mutta ei ole eka kerta kun Traficom, verottaja yms ovat tulkinneet asioita EU tarkoituksen vastaisesti (autoverot, ELV jne...)

Laitanpa vastauksessani myös parin viikon aikarajan heille. PIdäthän meidät ajan tasalla miten sun homma etenee. Helpointa verkkoyhtiölle olisi varmaan vain vaihtaa se mittari nyt jo halukkaille. Halukkaita on varmaan vain murto-osa kaikista asiakkasta, eli lämpöpumppufoorumin jäsenet.

Mihin sinä taajuustietoa tarvitset? Keppihevoseksi sille, että voit sanoa, ettei HAN-portti täytä direktiivin vaatimusta *kaiken* kerätyn datan jakamiseen?
Vaikka siihen ja se olisi myös loistavaa kun HAN portista tulisi aktiivisesti kaikki data, niin pystyisi käyttämään reservimarkkinaohjaukseen suoraan HAN dataa ilman erillistä mittausta.
Se avaisi ovia myös moneen businekseen taajusmarkkinoilla plug’n’play tyylisellä laitteistolla.
Mielestäni se on kaikkien etu kun data on avointa ja helposti kaikkien saatavilla, kuten esimerkiksi tässä tapauksessa EU säädös sen määrää

Carunan vastaus. Harkinnassa Traficomille kantelun tekeminen:

Hei,

kiitos viestistänne ja tarkemmista perusteluistanne, joihin olemme tutustuneet huolella.

Kuten esitimme 23.9.2025 päivätyssä viestissä, EU:n datasäädöksen (2023/2854) datanjakamisvelvoite ei koske Carunan omistaman sähkömittarin tuottamaa dataa. Asiakas ei ole datasäädöksen tarkoittama käyttäjä. Perustelemme tätä tarkemmin alla.

Käyttäjällä tarkoitetaan datasäädöksen 2(12) artiklan mukaan "oikeushenkilöä tai luonnollista henkilöä, joka omistaa verkkoon liitetyn tuotteen tai jolle kyseisen verkkoon liitetyn tuotteen tilapäinen käyttöoikeus on sopimuksella siirretty taikka joka vastaanottaa tuotteeseen liittyviä palveluja".

Asiakaslaskutuksessa käytettävän sähkömittarin omistaa Caruna, joka myös kantaa siitä huolto- ja vaihtovastuun lainsäädännön ja laitteen teknisten vaatimusten mukaisesti. Vaikka sähkömittari sijaitsee asiakkaan tiloissa tai sen läheisissä tiloissa, sen omistusoikeus säilyy Carunalla ja sitä käytetään verkkoyhtiön lainsäädännöllisiin velvoitteisiin järjestää sähkönkäyttöpaikan sähköntoimitusten mittaus sekä mittaustietojen rekisteröinti ja ilmoittaminen sähkömarkkinoiden osapuolille. Asiakkaalle ei siis synny sellaista datasäädöksen tarkoittamaa omistusoikeutta tai vuokraus- tai leasingsopimukseen rinnastuvaa sopimusperusteista oikeutta, jonka kautta asiakkaalle syntyisi datasäädöksessä tarkoitettu käyttäjän rooli suhteessa sähkömittariin.

Olette maininneet, että käyttäjän rooli voi myös syntyä tuotteeseen liittyvän palvelun perusteella. Datasäädöksen 2(12) artiklan mukaisessa käyttäjän määritelmässä viitataan "tuotteeseen liittyvien palvelujen" käsitteeseen, jolla datasäädöksen 2(6) artiklan mukaan tarkoitetaan "muuta digitaalista palvelua kuin sähköistä viestintäpalvelua, mukaan lukien ohjelmistot, jotka on osto-, vuokraus- tai liisaushetkellä liitetty tuotteeseen siten, että verkkoon liitetty tuote ei pystyisi ilman sitä suorittamaan jotain sen toiminnoista, tai jotka valmistaja tai kolmas osapuoli myöhemmin liittää tuotteeseen lisätäkseen, päivittääkseen tai mukauttaakseen verkkoon liitetyn tuotteen toimintoja".

Tuotteeseen liittyvän palvelun käsitteellä viitataan siis nimenomaan digitaaliseen palveluun. EU:n komissio on täsmentänyt edelleen, että jotta digitaalista palvelua voidaan pitää datasäädöksessä tarkoitettuna tuotteeseen liittyvänä palveluna, kahden perusedellytyksen on täytyttävä: i) verkkoon kytketyn tuotteen ja palveluntarjoajan välillä on oltava kaksisuuntainen tiedonvaihto; ja ii) palvelun on vaikutettava verkkoon kytketyn tuotteen toimintoihin, käyttäytymiseen tai toimintaan. (Komission Data Act FAQ, version 1.3).

Komissio on edelleen täsmentänyt, että tilanteessa, jossa asiakas käyttää yhdistettyä tuotetta osana muuta palvelusopimusta, joka ei siirrä itse tuotteeseen liittyviä omistusoikeuksia, yhdistettyä tuotetta käyttävä henkilö ei ole datasäädöksen mukainen käyttäjä.

Sähköverkkopalvelun ostaminen ei ole datasäädöksessä tarkoitettu digitaalinen palvelu, joka synnyttäisi teille asiakkaana datasäädöksen mukaisen käyttäjän roolin suhteessa sähkömittariin. Myöskään verkkopalvelu, jossa esitetään sähkömittarin välittämää tietoa, ei siis täytä datasäädöksen mukaista tuotteeseen liitetyn palvelun määritelmää.

Näin ollen teille ei asiakkaana synny datasäädöksessä tarkoitettua "käyttäjän" roolia suhteessa sähkömittariin.

Huomaattehan, että vaikka datasäädöksen datanjakamisvelvoite ei koske Carunan omistaman sähkömittarin dataa, teillä on mahdollisuus tutustua kulutuksesta syntyviin tietoihin niin Caruna Plussan Sähkönseurannassa kuin sähkömarkkinalain perusteella luodussa Fingridin datahubissa.

Tulevaisuudessa Carunan sähköverkon alueen kiinteistöihin asennetaan kotiautomaatioliitäntäportilla varustettu sähkömittari, jonka avulla voitte ottaa käyttöön oman päätelaitteenne reaaliaikaiseen sähkömittarin tietojen lukemiseen. Halutessanne voitte tilata sähkömittarin vaihdon jo ennakkoon, tällöin veloitamme mittarinvaihdosta palvelumaksuhinnaston mukaisen maksun. Ihmettelen että Datasäädöksen esimerkeissä on mainittu auton vuokraus ja ajoneuvon vuokraajalla on oikeus auton tuottamaan dataan vuokrauksen ajalta. Siinä omistus, liisaus tms kohteeseen on huomattavan paljon kevyempi kuin kiinteistön energiamittari josta verkkoyhtiö kerää käyttäjän toimista dataa.

Caruna Oy:n kieltäytyminen myöntämästä minulle EU:n datasäädöksen (2023/2845) mukaista oikeutta päästä käsiksi käyttöpaikkani sähkömittarin tuottamaan reaaliaikaiseen dataan.

3. Asian kuvaus ja perustelut

Olen pyytänyt Carunalta pääsyä sähkömittarini dataan datasäädökseen vedoten. Caruna on toistuvasti kieltäytynyt tästä ja esittänyt yksityiskohtaiset, mutta nähdäkseni virheelliset, juridiset perustelut kannalleen (ks. liitteet).

Katson, että Carunan linjaus on tarkoitushakuinen yritys kiertää datasäädöksen velvoitteita ja pelata aikaa yhtiön omaan, myöhempään aikatauluun sopivalle mittarinvaihdolle. Tämä tapahtuu siitä huolimatta, että lainsäädäntöön on ollut aikaa valmistautua.

Carunan tulkinta on virheellinen seuraavista syistä:

Argumentti 1: En ole "käyttäjä", koska en omista mittaria.

Tämä sivuuttaa täysin sen, että olen palvelun vastaanottaja. Koko sähköverkkopalvelu, josta maksan siirtomaksua, perustuu mittarin tuottamaan dataan. On kestämätöntä väittää, etten olisi datasäädöksen tarkoittama käyttäjä suhteessa laitteeseen, joka mittaa minulle toimitettua ja minun maksamaani palvelua.

Argumentti 2: Sähköverkkopalvelu ei ole "tuotteeseen liittyvä digitaalinen palvelu".

Tämä väite on absurdi. Moderni sähköverkkopalvelu perustuu etäluettaviin, digitaalisiin älymittareihin, jatkuvaan tiedonsiirtoon ja kansalliseen digitaaliseen Datahub-järjestelmään. Caruna yrittää keinotekoisesti erottaa fyysisen sähkönsiirron siitä digitaalisesta ekosysteemistä, joka mahdollistaa sen toiminnan.

Argumentti 3: Komission FAQ-tulkinta.

Caruna vetoaa tulkintaan, jonka mukaan palvelun on vaikutettava tuotteen toimintoihin. Sähkömittarin ja verkkopalvelun suhde on täysin symbioottinen: ilman sähköä laite ei mittaa mitään, ja ilman mittaria palvelua ei voi laskuttaa. On ilmeistä, että vahvasti säännellyn kriittisen infrastruktuurin, kuten sähköverkon, kohdalla tulkinnan on oltava laajempi kuin esimerkiksi erillisten kuluttajatuotteiden, vaikkapa älyjääkaapin, kohdalla.

4. Pyyntö Traficomille

Edellä mainitun perusteella pyydän Traficomia antamaan asiassa sitovan ratkaisun ja ottamaan kantaa seuraaviin kysymyksiin:

  1. Onko sähköverkkoyhtiön asiakas datasäädöksen tarkoittama "käyttäjä" suhteessa etäluettavaan sähkömittariin, vaikka asiakas ei omista laitetta?
  2. Katsotaanko sähköverkkopalvelu datasäädöksen tarkoittamaksi "tuotteeseen liittyväksi palveluksi"?

Lisäksi katson, että Carunan tarjoama maksullinen mittarinvaihto asettaa kuluttajat eriarvoiseen asemaan ja tekee lakisääteisestä oikeudesta kaupallisen tuotteen.

Carunan tulkinta johtaa kestämättömään lopputulokseen, jossa EU:n datasäädös ei soveltuisi sähkönsiirtoon – yhteen yleisimmistä ja taloudellisesti merkittävimmistä palveluista, joita kuluttajat käyttävät. On lain hengen vastaista, että säädös, jonka tavoite on antaa kuluttajille valta omaan dataansa, jättäisi ulkopuolelle juuri sen datan, jolla kuluttaja voisi reaaliaikaisesti hallita yhtä kotitaloutensa suurimmista menoeristä ja tehdä tietoon perustuvia säästöpäätöksiä.

Kantelu on on todennäköisesti turha. Verkkoyhtiöille on sähkömittarien vaihtoon Suomessa annettu aikaa 4.7.2031 asti. Tästä siis on todennäköisesti myönnetty poikkeama.

Mittarivaihto on mahdollisuus vaikuttaa että EU säädös saadaan toteutettua. Mittareiden HAN portti ei tarvitse suomen lain mukaan olla käytössä kuin vasta 1.1.2026, jolloin Data Actin toteutus pitää olla toteutettavissa myös ennen sitä.
Jos asiakkaat eivät olisi käyttäjiä, niin mittareihin ei generoituisi energian käytöstä generoitunutta kulutusdataa.
Lisäksi mittari on selkeästi yksilöity sopimuksessa osaksi käyttäjän käyttöpaikkaa.
Caruna väitti vastineessaan:
"Asiakkaalle ei siis synny sellaista datasäädöksen tarkoittamaa omistusoikeutta tai vuokraus- tai leasingsopimukseen rinnastuvaa sopimusperusteista oikeutta, jonka kautta asiakkaalle syntyisi datasäädöksessä tarkoitettu käyttäjän rooli suhteessa sähkömittariin."
Tämä väite on väärin. Sopimukset osoittavat:
  1. Asiakkaalla ON sopimusperusteinen oikeus käyttää mittaria osana verkkopalvelua
  2. Mittari on yksilöity sopimuksissa - se ei ole anonyymi infrastruktuurikomponentti
  3. Sopimukset ovat pitkäaikaisia ja vakaita (Sähkön verkkosopimus ja Sähkön liittymissopimus)
  4. Sopimukset luovat oikeudellisen yhteyden asiakkaan ja mittarin välille

Data Actin käyttäjämääritelmä täyttyy

Data Actin 2(12) artiklan mukaan "user" on "luonnollinen henkilö, joka omistaa verkkoon liitetyn tuotteen tai jolle kyseisen verkkoon liitetyn tuotteen tilapäinen käyttöoikeus on sopimuksella siirretty"
Näiden sopimusten perusteella:
✅ "Tilapäinen käyttöoikeus" - Sopimus on voimassa toistaiseksi, mutta ei pysyvä omistus → tilapäinen
✅ "Sopimuksella siirretty" - Kaksi erillistä sopimusta Carunan kanssa
✅ "Verkkoon liitetty tuote" - Mittari on yksilöity sopimuksissa numerolla

Asiakkaalla ON Data Actin 2(12) artiklan mukainen "käyttäjä"-asema, koska:
  1. ✅ Sähkömittari on "connected product"
  2. ✅ Asiakkaalla on "tilapäinen käyttöoikeus sopimuksella siirretty":
    • Kaksi erillistä sopimusta
    • Mittari yksilöity sopimuksissa
    • vuosia voimassa ollut käyttösopimus
    • Voimassa toistaiseksi
  3. ✅ "Vakaa oikeus" -kriteeri täyttyy
  4. ✅ "Riskit ja edut" -kriteeri täyttyy

Carunan vastine on ristiriidassa tosiasioiden kanssa:

Caruna väitti: "Asiakkaalle ei synny sopimusperusteista oikeutta"
Todellisuus: Asiakkaalla on KAKSI erillistä sopimusta, joissa mittari on yksilöity

Sopimusten olemassaolo tekee Carunan argumentista oikeudellisesti kestämättömän. Asiakkaalla on selvästi "tilapäinen käyttöoikeus sopimuksella siirretty" mittariin.

Varaudumme Data Act-säädökseen seuraamalla kansallisen lainsäädännön etenemistä, jossa tarkat vastuut ja velvollisuudet mittausdatan osalta tullaan määrittelemään tarkemmin. EU:n Data Act antaa raamit, joiden perusteella jäsenvaltioiden tulee valvoa säädöksen toteutumista. Suomessa lainsäädäntö on vielä kesken, joten emme koita ennakoida tulevaa kehitystä ennen kuin on tiedossa mitä tarkalleen vaaditaan.

Selvittelin miten mersuista saa dataa ladattua tietokoneelle. Lyhyt vastaus : Ei mitenkään(järkevästi).
Pitkä vastaus : Pitää kyttää Mecedes app:ia puhelimessa( android tai iphone, ei muita) , ladata se sieltä muutaman painalluksen kautta zippinä.
Ja sitten käsin siirtää se tietokoneelle.

Eli ei mitenkään ole automatisoitavissa järjellisellä työllä.
Maksamalla pienen summan kuukausittain pääsisi netin kautta noihin käsiksi kun on oma firma eu:n alueella. Samalla siitä saisi aikaiseksi tuotteen jolla voisi sitten rahastaa muita mutta tuntuu aika oudolle että omasta datasta pitäisi maksaa.

Sotii hiukan EU:n "open data" ppykälää vastaan.

Pitäköön tunkkinsa, helpommin saan tehtyä can väylään snifferin joka sitten puhelimen tms kautta forwardoi tarvittavat tiedot kotikoneelle.
Ehkä sitten eläkkeellä ehdin tuon tekemään ( tarve tosin postuu silloin kun ajot onkin epämääräisin aikoihin).

Hämmentävä vastaus Traficomilta, ihan kuin olisivat itse datasäädöksestä pihalla?
Onko kukaan Carunalta kantelun tehneistä saanut mitään vastausta Traficomilta asian liittyen?

Kysyin Traficomilta, miten pitää menetellä jos laitevalmistaja rikkoo EU Data Actin määräyksiä:

"Miten kansalaisen tulee toimia jos hän epäilee, että laitevalmistaja ei noudata Data Actin määräyksiä?
A. Siirtymäaikana
B. Siirtymäajan jälkeen.
Onko menettelyssä eroa jos kyseessä on suomalainen, EU-maalainen vai EU:n ulkopuolinen yritys?

Kansallisen lain ollessa parhaillaan eduskunnan käsiteltävänä Traficomilla ei ole toistaiseksi toimivaltaa tehdä data-asetusta koskevia päätöksiä. Voimme kuitenkin antaa ohjausta ja neuvontaa. Valitusasioiden osalta pyrimme sekä ennen kansallisen lain voimaantuloa, että myös sen jälkeen, ensisijaisesti ohjauksella ja neuvonnalla siihen, että toimijat noudattaisivat asetusta.

Mikäli yhteisymmärrykseen ei päästä ohjauksen ja neuvonnan keinoin, voimme jättää valitusasian odottamaan kansallisen lain voimaantuloa ja mikäli asia on lain voimaantulon jälkeen edelleen relevantti, voimme ottaa asian käsittelyyn ja antaa valituskelpoisen päätöksen.

Data-asetuksen 38 artiklan mukaan luonnollisilla henkilöillä ja oikeushenkilöillä on oikeus tehdä valitus sen jäsenvaltion toimivaltaiselle viranomaiselle, jossa heidän vakinainen asuinpaikkansa tai työpaikkansa taikka sijoittautumispaikkansa sijaitsee. Näin ollen Suomessa asuvat ja työskentelevät henkilöt sekä Suomeen sijoittautuneet yritykset voivat tehdä valituksen Traficomille ja Kilpailu- ja kuluttajavirastolle. Jos valituksen kohteena on muu kuin suomalainen yritys, voi valituksen tehdä Traficomille, joka datakoordinaattorina siirtää valituksen käsiteltäväksi sen maan kansalliselle viranomaiselle, jossa valituksen kohteena olevan yrityksen päätoimipaikka sijaitsee tai EU:n ulkopuolisen yrityksen kyseessä ollessa, siihen maahan, jossa yrityksellä on laillinen edustaja EU:ssa. Suomalaisia yrityksiä koskevat valitukset käsittelee asiasta riippuen joko Traficom tai Kilpailu- ja kuluttajavirasto. Henkilötietojen suojaa koskevissa kysymyksissä toimivaltainen viranomainen on Tietosuojavaltuutettu."
Tuo on kuin jokin geneerinen vastaus ilman aiheeseen liittyvää kantaa. Siirtymäaika on ohi datasäädöksen tiedonkeruun osalta, mutta voimassa uusien laitteiden rajapinnan osalta

Miksi minulla on sellainen käsitys että EU-asetus astuu voimaan heti velvoittavana eikä vaadi kansallista lainsäädäntöä?


Asetukset ovat säädöksiä, jotka ovat kaikilta osin sitovia. Niitä sovelletaan suoraan ja yhtäläisesti kaikissa EU-maissa heti niiden tultua voimaan. Niitä ei tarvitse erikseen saattaa osaksi kansallista lainsäädäntöä.

Ymmärtäisin niin, että periaatteessa säädökset jo velvoittavat toimijoita. Mutta jos ne eivät niitä noudata, ei asialle voi mitään niin kauan, kun lainsäätäjät eivät ole määritelleet rangaistuksia tai ylipäätään sitä kuka hommaa valvoo. Onko nämä kaikki toimet jo Suomessa hoidettu, siitä minulla ei ole käsitystä.

EU tasolla on sanktiot olemassa. Niissä sovelletaan samoja sakkoja kuin GDPR rikkomuksista. Traficom on Suomessa valvova viranomainen.
Siksi tuo Traficomin antama vastaus, mikä jaettu Facebookissa hämmästyttää

Tuo sähkömittarin datan excludauksen tulkinta, koska mittari ei ole kiinteistön omaisuutta on energiavirastosta käsin tullut.
Pääsin aiheesta haastattelemaan oikeustieteen proffaa, joka perehtynyt Datasäädökseen. Hänen tulkintansa oli että verkkoyhtiöiden tulee jakaa mittaridata, koska datan jakaminen ei ole sidoksissa omistamiseen vaan käyttöön. Perusteli leasing- ja vuokraus periaatteista, sekä siitä että kiinteistön ja verkkoyhtiön välillä on sopimussuhde mikä jo takaa saannin dataan.
Suomen valtio on myös jälkijunassa, kun aiheeseen liittyvä lainsäädäntö olisi pitänyt olla voimassa säädöksen voimaantullessa. Siihen tuo Traficomin vastaus onkin validi
